The rules

All sectional title schemes in South Africa have to operate with rules, at two levels: the management of the building and the conduct of those living within it. Owners who choose to rent out their apartments should note that they are required to bring the conduct rules to the attention of tenants and short-stay visitors.

The conduct rules require that:

  • Other occupants are allowed to quietly enjoy their own apartments.
  • No loud radios, TVs, or other gizmos.
  • Keep the place clean, nothing to be left in the common areas.
  • Anyone occupying the your place in your absence must be registered with the office.
  • No animals are allowed without the permission of the trustees.
  • Nothing is to be hung or shaken out of the windows, nor on the balconies.
  • No ball games or other hazardous activities.
  • You are responsible for your own insurance.

The management rules concern:

  • The address of the body corporate.
  • The rules for the appointment and working of trustees.
  • The procedures for meetings of trustees and the minutes of those meetings.
  • The differences between 'luxurious' and 'non-luxurious' improvements to the building.
  • The role of the managing agent and the management of funds.
  • The procedures for general meetings of owners and occupiers.
  • The duties of owners and occupiers.
  • The consequences of the heritage nature of the building.

If you are materially interested in any part of the building, as an owner or as a resident, you should familiarise yourself with these rules.
